National Non-Domestic Rate Relief

Summary

1.1

Application for Discretionary Rate Relief under Section 47 (2) of the Local Government Finance Act 1988.

Recommendation

2.1

To consider the application for discretionary relief for the period 14th September 2007 to 29th September 2007.

Report

3.1

At their meeting on 29th June 2005 Members agreed to delegate the power to award rate relief where a precedent has already been set and the application is consistent with both the criteria for that particular relief and other similar awards. Any other applications would be referred to Committee for consideration.

3.2

The Council may grant discretionary relief, under the provisions of Section 47 (2) of up to 100% of the charge levied in the circumstances whereby the applicant satisfies the following conditions:

• the hereditament is not an excepted hereditament, and all or part of it is occupied for the purposes of one or more institutions or other organisations none of which is established or conducted for profit and each of whose main objects are charitable or are otherwise philanthropic or religious or concerned with education, social welfare, science, literature or the fine arts;

• the hereditament is not an excepted hereditament, it is wholly or mainly used for purposes of recreation, and all or part of it is occupied for the purposes of a club, society or other organisation not established or conducted for profit.

3.3

Where discretionary relief only is awarded, the Council meets 25% of the cost of the relief.

3.4

The following application has been received, and no precedent has been set by awarding discretionary relief to this type of organisation.

Name: Berwick Film and Media Arts Festival

Property: Former Blackburn and Price Buildings, Silver Street (n.b. only part of the total

property to be occupied).

Period: 14.09.07 to 29.09.07

Total cost of discretionary relief: £409.16

Cost to Berwick Borough Council: £102.29

Use: Exhibition of Art Works (Visual and Audio).
