361. 1. DECLARATION OF INTEREST 1

Councillor A R Bowlas declared an interest in Item 5 and left the meeting during consideration of the item.

362. 2. MINUTES OF THE MEETING OF THE LICENSING COMMITTEE HELD ON 22 SEPTEMBER 2004 1

DECISION: To approve as a correct record the Minutes of the Licensing Committee held on 22 September 2004.

363. 3. HIGH COURT DECISION: PRIVATE HIRE OPERATOR’S LICENCE NOT REQUIRED BY HACKNEY CARRIAGES 1

DECISION: To note:

(i) the decision of the High Court in Brentwood Borough Council v Gladen of 28 October 2004;

(ii) the consequent changes to taxi licensing; and

(iii) the necessity for the Council to make refunds in respect of Private Hire Operator’s Licence fees in relation to Hackney Carriages.

364. 4. DISABILITY DISCRIMINATION ACT 1995: TAXI LICENCE PLATES 3

DECISION: To:

(i) note the necessity to change the Taxi Licence Plates to be compliant with the Disability Discrimination Act 1995;

(ii) approve giving the option to Hackney Carriage and Private Hire Vehicle proprietors of Taxi Licence Plates constructed from either fibreboard (a rigid material like the existing plates) or a flexible magnetic material;

[Note: The availability of flexible Taxi Licence Plates will not relieve proprietors of their responsibility to affix the said Plate externally to the vehicle, in a position specified by the Council (i.e. rear near / left side) and where it is clearly visible.]

(iii) approve the new size, shape and colour (red border with white centre) of Private Hire Vehicle licence plates; and

(iv) reserve the decision on the new size, shape and colour (green border with white centre) of Hackney Carriage licence plates, until a specimen licence plate is available in an alternative, lighter shade of green, for approval by the Licensing Committee.

365. 5. PUBLIC ENTERTAINMENT LICENCE: ‘CASHMERE NIGHTCLUB’, GOLDEN SQUARE, BERWICK-UPON-TWEED 5

DECISION: To make the Provisional Public Entertainment Licence granted on 23 June 2004 final, on the terms of the said provisional licence, subject to the standard conditions, pursuant to the Council’s Regulations of 2000, and as follows:

(i) the maximum capacity of the premises, to be specified in paragraph 3 of the licence, shall be 380 (three hundred and eighty) persons to the ground floor and 100 (one hundred persons) persons to the first floor;

(ii) the number of Door Supervisors, who shall be registered with the Security Industry Authority, to be specified in paragraph 4 of the licence, shall be;

a. two Door Supervisors for a total premises occupancy of up to 100 (one hundred) people;

b. six Door Supervisors for a total premises occupancy of between 101 (one hundred and one) people to 250 (two hundred and fifty) people; and

c. eight Door Supervisors for a total occupancy exceeding 250 (two hundred and fifty) people and not exceeding its maximum capacity of 480 (four hundred and eighty) people;

(iii) the period of the licence, to be specified in paragraph 8, shall be twelve months, namely from 23 November 2004 to 22 November 2005; and

(iv) that there be a special condition attached to the licence, namely to require the CCTV system at the premises to be constantly monitored.
