Local land charges search
The Local Land Charges section carries out all official searches covered by the Local Land Charges Act 1975 guaranteeing comprehensive replies to the official LLC1 (registerable charges, improvement grants, tree preservation orders etc.) and CON 29 (road schemes, planning history etc.) enquiries
What are Local Land Charges?
Local Land Charges are outstanding charges that local or central government can demand from successive owners or occupiers of property or land, or restrictions on the use of property or land. These include charges for services such as roads, or restrictions like Smoke Control or Tree Preservation Orders.
Details of any charges that are registered against land and property are listed in a Local Authority's Local Land Charges Register. The Register also details other important non-financial information, for example relating to planning decisions.
The Register contains twelve parts and is updated on a daily basis as and when new charges and amendments are notified to the Land Charges Department.

The Local Land Charges Department
The Local Land Charges Department is responsible for maintaining the Local Land Charges Register and for dealing with applications for official searches of that Register received from members of the public either on their own behalf or through their Solicitors, conveyancers, personal search agencies or electronically through the National Land Information Service (NLIS)
What is a Local Land Charges Search?
It is important when buying or leasing a property to carry out a search of the Local Land Charges Register to discover whether any restrictions or charges such as those set out above affect the property and whether you will be taking on any responsibilities or financial charges when you purchase the property.
The Search
Form LLC1
This is an official request that you or your solicitor can submit to the Authority to obtain information listed in the Register about the property.

Full Search
This is the search we recommend for all property purchases and consists of a questionnaire CON29, as well as Form LLC1. CON29 contains standard questions in Part One and a section for additional enquiries in Part Two.
It is commonplace for the full search to be carried out by all prospective property purchasers as it offers the most comprehensive protection; this is the only search that highlights current significant local factors and proposed developments. The standard questions are sent to various council departments and provide additional information about the property that is not included on Public Registers, for example these questions may reveal proposals for Compulsory Purchase Orders, Traffic Schemes or Building Regulations.
The results of these searches may help you decide whether or not to go ahead with your purchase.
There is a separate charge for each additional question you ask on Part Two of questionnaire CON29.
Forms LLC1 and CON29 are available from Law Stationers and a plan in duplicate will need to be submitted with each search

Please note we do not operate an expedited search service.
We aim to process all searches within 10 working days in accordance with Best Value Performance Indicator 179.
NLIS
The National Land Information Service is available to solicitors and conveyancers only and enables an online one-stop-shop for land and property related information held by many organisations, for example, Land Registry, Local Land Charges, and Water Companies
Berwick-upon-Tweed Borough Council is part of the Government initiative to automate the processing of Local Land Charges Searches. We are currently at level 2.
